Fiancée Visa Attorney

How do I get a Fiancée Visa?

To obtain a fiancé(e) visa, also known as a K-1 visa, you must follow the application process established by the U.S. Citizenship and Immigration Services (USCIS). Here are the general steps to apply for a fiancé(e) visa:

  1. Determine Your Eligibility: Make sure you meet the requirements for a fiancé(e) visa. You must be a U.S. citizen, both you and your fiancé(e) must be legally free to marry, and you must have met each other in person within the last two years, unless there are exceptional circumstances that make meeting in person impractical or would create extreme hardship.
  2. File Form I-129F: Petition for Alien Fiancé(e): As the U.S. citizen sponsor, you need to file Form I-129F with USCIS, along with the necessary supporting documents. This form establishes your relationship with your fiancé(e) and demonstrates your intention to marry within 90 days of their arrival in the U.S.
  3. Gather Supporting Documents: Include supporting documents with your Form I-129F petition. These may include evidence of your U.S. citizenship, proof of your relationship (such as photographs, correspondence, or travel documentation), documents establishing your intent to marry (e.g., a statement of intent to marry from both parties), and any other required evidence specified in the form instructions.
  4. Pay the Required Fees: Pay the filing fee for Form I-129F and any other associated fees as required. Check the USCIS website for the current fee amounts and acceptable payment methods.
  5. USCIS Processing and Approval: USCIS will review your petition, conduct background checks, and make a decision. If approved, USCIS will forward your case to the appropriate U.S. embassy or consulate in your fiancé(e)’s home country.
  6. Embassy/Consulate Processing: After receiving the approved petition, the U.S. embassy or consulate will provide instructions to your fiancé(e) to apply for a K-1 visa. This typically involves completing additional forms, providing supporting documents, attending a medical examination, and attending an interview.
  7. Attend the Visa Interview: Your fiancé(e) will attend an interview at the U.S. embassy or consulate in their home country. They will be asked questions about their relationship with you, their background, and their intentions to marry and live in the U.S.
  8. Visa Issuance and Entry: If approved, your fiancé(e) will receive the K-1 visa in their passport, allowing them to travel to the U.S. Within 90 days of their entry into the U.S., you must get married, and your fiancé(e) can apply for adjustment of status to obtain lawful permanent residency (green card).

Note that the process may vary in different countries, and additional documentation or steps may be required. It is recommended to consult with an immigration attorney or the embassy/consulate for specific guidance and requirements that apply to your situation.
