DACA Renewal Attorney

  3. Provide Supporting Documentation: Gather the necessary supporting documents to accompany your DACA renewal application. This typically includes documents to establish your identity, such as a copy of your previous DACA approval notice and current passport or identity document. Additionally, you may need to provide supporting evidence of meeting the eligibility criteria, such as school records, medical records, employment records, or documentation of military service.
  4. Complete Form I-765: Along with Form I-821D, you will need to complete Form I-765, Application for Employment Authorization. This form allows you to request an Employment Authorization Document (EAD), which provides work authorization.
  5. Pay the Required Fees: Submit the appropriate filing fee with your DACA renewal application. As of September 2021, the fee for Form I-821D is $495, and the fee for Form I-765 is $550. Some individuals may be eligible for fee exemptions or waivers based on their financial circumstances.
  6. Submit the Application: Mail your completed forms, supporting documents, and fees to the appropriate USCIS address as indicated on the USCIS website and the application instructions. Be sure to make copies of everything for your records.
  7. Await USCIS Response: USCIS will review your application, process your biometrics (fingerprints), and conduct a background check. They will then make a decision on your DACA renewal application. You should receive a written notice of their decision.
