Asylum Cases Attorney

Asylum cases in the United States involve individuals seeking protection due to a well-founded fear of persecution in their home country. To apply for asylum in the U.S., here’s a general overview of the process:

  1. Arrival in the U.S.: You must physically arrive in the United States or be present at a U.S. port of entry to apply for asylum. If you are already in the U.S., you generally have one year from your date of arrival to apply for asylum. There are some exceptions to the one-year filing deadline.
  2. Filing Form I-589: Complete and submit Form I-589, Application for Asylum and for Withholding of Removal, to the U.S. Citizenship and Immigration Services (USCIS). Include detailed written statements explaining why you are seeking asylum, providing specific details of the persecution you faced or fear. It is crucial to provide strong, credible, and consistent evidence to support your claim.
  3. Biometrics Appointment: After filing your application, you will be scheduled for a biometrics appointment at an Application Support Center (ASC) to capture your fingerprints, photograph, and signature.
  4. Asylum Interview: USCIS will schedule an interview to assess your asylum claim. During the interview, an asylum officer will ask questions to determine the credibility and validity of your case. You should be prepared to provide further details about your claim and supporting evidence.
  5. Supporting Evidence and Documentation: It is essential to gather and submit any supporting evidence that can authenticate your claim, such as documents, photos, witness statements, or expert testimonies. Medical reports, news articles, or country condition reports may also be relevant.
  6. Adjudication: After the asylum interview and considering the evidence presented, USCIS will decide whether to grant asylum. If approved, you will be granted asylum status and be eligible to apply for a work permit (Form I-765). If denied, you may be referred to immigration court proceedings and may have an opportunity to present your case before an immigration judge.
  7. Immigration Court Proceedings: If referred to immigration court, your case will be assigned to an immigration judge. A new hearing will be scheduled where you can present your asylum claim again and provide additional evidence. The judge will issue a decision either granting or denying asylum. If granted, you will receive asylum status and be on the path to obtaining a green card.

It’s important to know that asylum cases can be complex, and having legal representation by an experienced immigration attorney can greatly help in building a strong case, gathering evidence, and navigating the asylum process. They can provide guidance and support throughout the entire process.
